| A New York appeals court has tossed out Levon Helm's 2004 lawsuit against the BBDO ad agency, saying it had the right to use The Band's "The Weight," featuring Helm on vocals, in an ad for Cingular Wireless. The court says the contract Helm and The Band signed with Capitol gave the label permission to license it to the agency. His lawyer, John O'Neill, had argued that it gave the label permission only to promote the music itself.
Helm has long been at odds with The Band's Robbie Robertson, claiming he and the other members of the group should be entitled to songwriting credits and royalties, as the songs were crafted with their input in the studio.
