LED ZEPPELIN: Switching to Offense
Their lawyers plan to argue that Spirit‘s lawsuit over “Stairway to Heaven” should be thrown out because it was filed in Pennsylvania, to which they have no connection.
Lawyers for Led Zeppelin have formulated their first line of defense against the lawsuit filed by the heirs of Spirit‘s Randy Craig Wolfe (a.k.a. Randy California) who say “Stairway to Heaven” ripped off Spirit’s “Taurus.”
The suit was filed in Pennsylvania, and their lawyers claim that the Zeppelin has no connection to that state. A memorandum says, “The individual defendants are British citizens residing in England, own no property in Pennsylvania and have no contacts with Pennsylvania, let alone ties sufficient to render them essentially at home here. Under established case law, no good faith basis exists to argue the Court has general jurisdiction over them.”
They are asking that the case be dismissed. If it is not, then they want it moved to California, where Spirit is from.
